Garage crashes car

    Hey guys, just wondering what are my options with this problem, I left my car out to a garage to get work done on, he rings yesterday saying jobs done, I said I'll pick it up the weekend, he rang this morning saying his mate is after crashing it and it's written off? Any advice ?

    You're covered by law and the consumer rights act. Ask them to fix it, if they refuse take them to court. A quick search on which? website brought this up hope it helps;

    When you take your car into a garage, it's protected under the law of bailment, which says that anyone you entrust with your property has a responsibility to take reasonable care of it.

    If they fall short of this, they're responsible for any damage or loss incurred while your car is in their possession.

    In addition, the Consumer Rights Act (which replaces the Supply of Goods and Services Act from 1 October 2015) says that your garage must provide its service with reasonable care and skill and will be responsible for any damaged caused if it doesn't.

    Garages might display notices denying responsibility for loss or damage to vehicles in their possession.

    But under the Consumer Rights Act, which replaces the Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contract Regulations 1999, these can't be used to try and take away, limit or restrict your legal rights.

    Whatever the cause, it’s very unlikely that a court would uphold a garage’s claim to be exempt from all responsibility.

    Should your car be damaged, you can claim compensation for the loss or damage and potentially, reasonable expenses incurred as a result, such as the cost of alternative transport while your car was off the road.

    Before incurring such costs, give the garage a chance to cover them or help with your arrangements.

    Garages insurance should cover it, unless he's saying his mate (who is not employed by the business) took the car for a ride an smashed it up.
    In which case the police need to do the driver for TWOC, and (i'm not sure) maybe the garage owner for allowing the car to be used without insurance???

    You'd then have to claim off your own insurance, or maybe sue the garage and the driver??

    Think there would also be a case for criminal charges and legal proceedings against the garage as they have a duty of care with your car whilst it's in their possession

    Cheers for the info guys, he's agreed to pay me for the car, so failing that, I'll have to go down the legal route, which I'd rather not do, doesn't say much for the garage when there out joy riding in a customers car [emoji35]

    I had it not so long ago, mine was in for some welding and an mot, they wrecked the front bumper, broke the sensor on my avcr, removed some of my coloured silicone wash jet hose and clocked up around 300 miles!!! They obviously denied it, said somebody must've got under the bonnet (whilst in their care) and broke and removed things, even though there's locking bonnet pins and they were the only ones with keys!

    Why would the bother and risk ruining there name and business, my car is absolutely wrecked and they hit a wall with it luckily enough they didn't hit another car or person

    Well it was a bit of a dodgy garage hence why I took it there for mot, but I've never left it with them before, it was purely for ease with the welding

    The garage I went to seemed to have all go reviews and done good work, all he was to do was to lengthen the clutch pedal for me

    I would give them the number I wanted for the car and then have it back. bet they want to keep it to break to get some cost back
